The Crossroads between Administrative Disability Law and Divorce
Last week I had the privilege to speak at the 15th Annual Family Law Stars Across the Bay CLE. I spoke about the intersection of Social Security Administration benefits (based in large part on the fantastic work of Attorney Brooke Thomas from Gardberg & Kemmerly) and VA disability benefits during a divorce.
There are multiple ways in which Social Security benefits can play a large role in a divorce. This can include problems with Supplemental Security Income (SSI) in the form of assets, either for eligibility purposes or a reduction of benefits. A reduction of benefits due to unearned income can also result in loss of healthcare benefits if divorce proceedings are not handled properly. Moreover, retirement benefits as well as Social Security Disability Insurance (SSDI) can become an issue as it can provide an additional or alternative income for ex-spouses and children of the worker.
